From parliamentary approval to legal force
Following its unanimous approval by all 133 members of the Catalan Parliament on June 17, 2026, the law has now completed its publication in the official gazette as Llei 8/2026. This step formalises its entry into force and triggers the deadlines for regulatory development.
Councillor Sílvia Paneque, head of Territori, Habitatge i Transició Ecològica, described the publication as “the start of the definitive stage” to eliminate asbestos from Catalonia, noting it is “pioneering at both the national and European level.”
What changes from today
With the Llei 8/2026 now in force, the following obligations and mechanisms are activated:
- Mandatory asbestos presence or absence certificate for all sales and rentals of buildings constructed before 2002.
- Creation of a Catalan census to register all asbestos-containing materials across the territory.
- Public administrations must identify, manage and remove asbestos from their properties.
- Companies and citizens must report known locations containing asbestos materials.
- Establishment of the Office for Asbestos Eradication, under the Agència de Residus de Catalunya.
- Sanctions regime with fines up to €100,000 for non-compliance with removal orders.
- A dedicated fund for asbestos management, removal, awareness and outreach.
