Real Estate & Asbestos
Pre-purchase surveys, disclosure requirements, and managing asbestos in property transactions.
The Challenge
Asbestos is a material consideration in property transactions worldwide. For buyers, the presence of undisclosed asbestos can represent significant unexpected costs — from management surveys and monitoring to full removal before planned renovations. For sellers, failure to disclose known asbestos can result in legal liability and collapsed transactions.
The real estate sector sits at the intersection of asbestos regulation, property law, and financial due diligence. Different countries have vastly different requirements regarding pre-sale surveys, seller disclosures, and buyer protections. In some markets, asbestos surveys are mandatory before any transaction; in others, the obligation falls on the buyer to investigate.
Estate agents, conveyancers, and property developers need to understand when asbestos surveys are required, what they cover, how results affect property values, and what remediation options exist to facilitate transactions.
Common Asbestos Findings in Property Surveys
Pre-purchase asbestos surveys commonly identify the following materials, depending on the age and type of property:
- Textured decorative coatings (Artex) on ceilings — very common in pre-1990s properties
- Floor tiles, particularly 9-inch (228mm) vinyl tiles and their adhesive
- Roof and external materials: corrugated cement sheets, soffits, fascias, gutters
- Pipe insulation and boiler lagging in utility areas
- Asbestos insulating board in fire surrounds, partition walls, and ceiling tiles
- Garage roofing and outbuilding panels made from asbestos cement
- Less visible locations: behind electrical meters, inside soffits, under later flooring
- Mixed ACMs in buildings that have undergone multiple refurbishments

Property buyers, sellers, and their agents typically require:
Key Regulations
France: The DTA (Dossier Technique Amiante) is mandatory for all buildings built before July 1997. For residential sales, the DAPP (Diagnostic Amiante Parties Privatives) must be provided to the buyer before completion. This is one of the mandatory pre-sale diagnostics under French property law.
United Kingdom: There is no mandatory pre-sale asbestos survey for residential properties. However, commercial property transactions typically include asbestos surveys as part of due diligence. Buyers' solicitors routinely enquire about asbestos management plans for non-domestic properties.
United States: Seller disclosure requirements vary by state. Some states require disclosure of known asbestos; others follow a "buyer beware" principle. ASTM Phase I Environmental Site Assessments for commercial transactions include asbestos as a potential environmental condition.
Australia: In most states, sellers must disclose known asbestos in residential properties. Commercial transactions require an asbestos register as part of due diligence. Some states mandate a Hazardous Materials Survey for all sales of pre-1990 buildings.
